Legal Frameworks and Policy Incentives for Climate Change Mitigation and Resource Management
Environmental legislation serves to prohibit, restrict, and regulate environmentally harmful practices. More recently, however, the importance of environmental, legal, and policy frameworks to work as incentives for activities that benefit the environment has increased, that is, to discourage negative externalities by encouraging positive externalities. As an example, the Kyoto Protocol states that the reduction of GHG emission to set target levels should primarily be reached through national measures, for example, carbon taxes (Metcalf and Weisbach, 2013), while there are additional, market-based, means of meeting the target levels such as the Clean Development Mechanism (CDM) (Millock, 2013). As a policy incentive, the CDM can be regarded as an international payments for ecosystem services (PES) program. PES schemes aim to encourage environmental protection through remuneration of landowners for providing positive externalities, for example, carbon sequestration, preservation of biodiversity habitats, and water purification (Forest Trends et al., 2008; Parkhurst, 2013). Environmental policy may also be an instrument for stimulating innovation and technological change (Nemet, 2013), although the empirical evidence is not conclusive regarding the effects of past and current policy incentives on energy efficient technological developments (Johnstone and Haščič, 2013). In conclusion, it is important for environmental and energy legal and policy frameworks to address the issue of sustainable energy sources to encourage continued innovation and development of clean technologies and to avoid carbon technology lock-in (Foxon, 2013).
